Overview
This website, www.dukescoffeesroasters.com (the “Website”), is operated by Duke’s Coffee Roasters (“Duke’s,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Website and your purchase of our products, including coffee subscriptions (together, the “Service”).
By using the Website or placing an order, you agree to these Terms and to any additional policies referenced here, including our Shipping Policy and Return & Refund Policy. How we collect and use personal information is explained in our Privacy Policy. If you do not agree, please do not use the Website or place an order.
Our online store runs on WordPress and WooCommerce and is hosted by Bluehost. Payments are processed by Stripe.
1. Eligibility and Accounts
You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. You are responsible for keeping your account login secure and for all activity under your account. Please notify us promptly if you believe your account has been used without your permission.
2. Our Products
Freshly Roasted Coffee
Our coffee is roasted in small batches. Flavor, aroma, and appearance naturally vary from batch to batch and from harvest to harvest. Tasting notes on our Website describe what we find in the coffee. They are not ingredients or added flavors.
Availability
Many of our coffees are seasonal or limited lots. We may run out of, substitute, or discontinue a coffee at any time. If a coffee in your order or subscription is unavailable, we will contact you or, for subscriptions, substitute a comparable coffee of equal or greater value / skip that shipment as described in Section 4.
Product Images
We do our best to show our products accurately, but colors may look different on your screen, and packaging may change.
Food Product
Our coffee is a food product. Store it as directed and use it within a reasonable time for best quality.
3. Orders, Pricing, and Payment
Pricing
Prices are listed in U.S. dollars and do not include shipping, which is shown at checkout. We may change prices at any time, but a price change will not affect an order we have already accepted. For subscriptions, see Section 4.
Order Acceptance
Your order is an offer to buy. We accept it when we ship it or send you a shipping confirmation. We may refuse or cancel any order, including for suspected fraud, resale, errors in pricing or product information, or products being unavailable. If we cancel an order after you have been charged, we will refund you in full.
Quantity Limits
We may limit quantities per person, household, or order, and may decline orders that appear to be placed by resellers. For wholesale inquiries, contact us at info@dukescoffeesroasters.com.
Payment
You agree to provide current, complete, and accurate billing information and to keep it up to date so we can complete your purchases and subscription renewals.
Errors
If we discover a pricing, product, or shipping error, we may correct it and cancel or update affected orders, even after you have placed them. If we do, we will let you know and give you the option to proceed at the correct price or cancel for a full refund.
4. Subscriptions (Subscribe & Save)
How It Works
When you start a subscription, you choose the coffee, quantity, grind, and delivery frequency. Your subscription renews automatically, and we will charge your payment method on file the subscription price shown at checkout, plus applicable shipping, every billing cycle at the frequency you selected, until you cancel. Your first charge occurs when you sign up; each later charge occurs on your renewal date, before shipment.
Subscription Discount
Subscription pricing includes the discount shown at checkout. If we change subscription pricing, we will email you at least 14 days before the new price applies to your next renewal, and you may cancel before then.
Changing, Skipping, or Pausing
You can change your coffee, quantity, or frequency, or skip or pause a shipment, from “My Account” on our Website. Changes made after a renewal has been charged apply to the next shipment.
Cancelling
You can cancel at any time, online, from “My Account.” Cancelling stops all future charges. Shipments already charged before you cancel will still be sent and are subject to our Return & Refund Policy.
Failed Payments
If a renewal payment fails, we may retry the charge, pause the subscription, or cancel it. We will notify you by email.
Our Right to End a Subscription
We may end a subscription program or your subscription at any time. If we do, we will notify you and refund any charge for a shipment we do not send.
Confirmation and Reminders
After you sign up, we will email you a confirmation that includes these subscription terms and how to cancel.
5. Shipping, Returns, and Refunds
Shipping and returns are governed by our Shipping Policy and Return & Refund Policy, which are part of these Terms. Title to and risk of loss for products pass to you when we hand them to the carrier. If anything in those policies conflicts with these Terms, those policies control for shipping and returns.
6. Website Content and Intellectual Property
All content on the Website, including our name, logo, product names, photos, text, and graphics, belongs to Duke’s or our licensors and is protected by intellectual property laws. You may not copy, reproduce, sell, or otherwise use any part of the Website or its content for commercial purposes without our written permission.
7. Reviews, Comments, and Submissions
If you post a review or send us comments, feedback, photos, or ideas (“Submissions”), you give us a non-exclusive, royalty-free, perpetual, worldwide license to use, edit, copy, publish, and display them in any medium, including in our marketing. We are not required to keep Submissions confidential, pay for them, or respond to them.
You agree that your Submissions are truthful, reflect your honest experience, are your own work, and do not violate anyone’s rights or contain unlawful, abusive, obscene, or misleading material or malicious code. You may not use a false email address or pretend to be someone else. We may, but are not required to, monitor, edit, or remove Submissions that we consider objectionable or that violate these Terms. We do not remove reviews simply because they are negative.
8. Prohibited Uses
You may not use the Website or its content:
- for any unlawful purpose, or to encourage others to act unlawfully;
- to violate any law, regulation, or ordinance;
- to infringe our intellectual property rights or those of others;
- to harass, abuse, threaten, defame, or discriminate against anyone;
- to submit false or misleading information, including fraudulent orders;
- to upload or transmit viruses or other malicious code;
- to spam, phish, scrape, crawl, or use automated tools to access the Website; or
- to interfere with or circumvent the Website’s security features.
We may suspend or end your use of the Website for violating these prohibited uses.
9. Third-Party Links and Tools
The Website may contain links to, or tools provided by, third parties (such as payment processors and shipping carriers). We do not control and are not responsible for third-party websites, tools, content, or products. Your use of them is subject to their terms, and any questions or complaints about them should be directed to the third party.
10. Website Availability and Accuracy
We try to keep the Website accurate and available, but we do not guarantee that it will be uninterrupted, error-free, or current at all times. We may change, suspend, or discontinue any part of the Website at any time. Information on the Website is provided for general information only.
11. Disclaimer of Warranties
Except as expressly stated in these Terms or required by law, the Website and our products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain warranties to be disclaimed, so some of these disclaimers may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, Duke’s and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Website or our products. Our total liability for any claim relating to the Website or our products will not exceed the amount you paid us for the products giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for personal injury caused by our negligence or for fraud.
13. Indemnification
You agree to indemnify and hold harmless Duke’s and its owners, employees, and agents from any third-party claim or demand, including reasonable attorneys’ fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your purchases will be resolved in the state or federal courts located in San Bernardino, State of California, except that either party may bring a qualifying claim in small claims court. Nothing in this section limits rights you have under the consumer protection laws of the place where you live.
15. Termination
These Terms remain in effect until ended by you or us. You may stop using the Website at any time and cancel any subscription as described in Section 4. We may suspend or end your access if we reasonably believe you have violated these Terms. Sections that by their nature should survive termination, including Sections 6, 7, 11, 12, 13, and 14, and any amounts you owe, will survive.
16. Changes to These Terms
We may update these Terms from time to time by posting the new version on this page and updating the “Last Updated” date. Changes apply to orders placed after they are posted. If we make a material change affecting active subscriptions, we will notify subscribers by email before the change takes effect.
17. General
These Terms and the policies referenced in them (our Shipping Policy, Return & Refund Policy, and Privacy Policy) are the entire agreement between you and us regarding the Website and our products, and they replace any prior agreements on that subject. If any provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver.
